Capacity Co., Ltd. (hereinafter — "Company")

This document sets out the terms of use of the website and related services provided by the Company.

Article 1 (Purpose)

These Terms govern the rights, obligations and liability of the Company and users when using the Company's website (hereinafter — "Site") and related services, including submitting requests (RFQ), obtaining information on products/services and communicating with the Company.

Article 2 (Definitions)

  1. "Site" — the internet resource operated by the Company, intended to inform about the Company's activities and to receive requests from users.
  2. "Services" — provision of information, receipt and processing of requests, preparation of commercial proposals, consultations, as well as other related services available on the Site.
  3. "User" — any person who accesses the Site and uses its functionality.
  4. "Request" (Inquiry / RFQ) — a User's communication to the Company via the Site forms/contact channels to obtain information, a quote, a proposal or terms of cooperation.
  5. "Content" — any materials on the Site (texts, images, files, documents, logos, design elements, etc.).

Article 3 (Publication and amendment of the Terms)

  1. The Company publishes these Terms on the Site in a manner that allows the User to review them.
  2. The Company may amend the Terms to the extent not inconsistent with the applicable legislation of the Republic of Korea, including legislation on personal data and regulation of standard terms.
  3. When amending the Terms, the Company shall specify the effective date of the amendments and publish the updated version on the Site in advance. If the amendments materially adversely affect the User's position, the Company shall post a notice in advance within a reasonable period.
  4. The updated Terms apply from the date of their entry into force.

Article 4 (Nature of information on the Site and absence of a public offer)

  1. The information on the Site is for reference only.
  2. The placement of information on products/services, range, specifications, terms, prices and logistics does not constitute a public offer.
  3. Any supply/provision of services is carried out solely on the basis of a separate contract, invoice and/or other commercial documents agreed by the parties.

Article 5 (Procedure for use of the Site)

  1. The User may use the Site to review information and submit Requests.
  2. The User undertakes to provide accurate and up-to-date data when completing forms.
  3. The Company may request clarification of information necessary to prepare a proposal, or refuse to process a Request if sufficient information is not provided.

Article 6 (Restrictions and User liability)

The User is prohibited from:

  1. disrupting the operation of the Site, attempting to gain unauthorised access to sections/systems;
  2. posting/transmitting unlawful materials through the Site forms;
  3. infringing the intellectual property rights of the Company or third parties;
  4. impersonating another person, using another person's contact details without authorisation.

Article 7 (Personal data)

  1. If the User submits a Request through the Site, the Company may collect the minimum necessary data (e.g. name, company, job title, e-mail, phone, country and content of the Request) solely for processing the enquiry and business communication.
  2. The detailed rules for the processing of personal data, retention periods, the User's rights and the contact details of the responsible person are set out in the Privacy Policy (개인정보처리방침) published on the Site.
  3. The processing of personal data is carried out in accordance with the legislation of the Republic of Korea on the protection of personal data (PIPA).

Article 8 (Intellectual property)

  1. The exclusive rights to the Content belong to the Company or the rightholders.
  2. Any copying, distribution, publication, adaptation or other use of the Content without the written consent of the Company is prohibited, except where expressly permitted by law.

Article 9 (Limitation of liability)

  1. The Company takes reasonable measures to ensure the correct operation of the Site but does not guarantee the absence of technical failures and interruptions.
  2. The Company is not liable for losses caused by:
    • use or inability to use the Site for reasons beyond the Company's control;
    • actions of third parties, including communication/hosting providers;
    • decisions made by the User on the basis of the reference information on the Site without a separate contract.
  3. Nothing in these Terms limits the Company's liability to the extent that such limitation is prohibited by applicable law.

Article 10 (Links to third-party resources)

The Site may contain links to third-party resources. The Company does not control their content and is not responsible for their operation or data processing policies.

Article 11 (Applicable law and dispute resolution)

  1. These Terms are governed by the legislation of the Republic of Korea.
  2. Disputes arising in connection with the use of the Site shall be subject to the jurisdiction of the competent court of the Republic of Korea, unless otherwise agreed by the parties in a separate contract.

Article 12 (Company contact information)

The Company's details (including business registration number, representative and address) are published in the footer of the Site and/or in the "Contacts" section.

Supplementary provisions

  1. These Terms enter into force from the moment of publication on the website.
  2. The previous version (if applicable) shall cease to have effect from the date of entry into force of this version.
